State Land Use Enacted Legislation

Bill # State Year Party Topic

AB 462

CA 2025 D Accessory dwelling units regulations, Allow ADUs where single-family homes are permitted, Appeals, By-right zoning, Deadlines, Density Increases, Impact fees, Other streamlining, Planning for climate adaptation and hazards, Streamline hearings

Provided by Furman

Summary

  • Expedites ADU development by requiring local agencies to issue a certificate of occupancy for an ADU constructed in a county subject to a proclamation of a state of emergency (regarding housing supply/land use), even if a certificate of occupancy has not been issued for a primary dwelling unit (does not apply to ADUs attached to the primary dwelling). Applies if:
    • The primary dwelling was substantially damaged or destroyed by an event referenced in a state of emergency issued by the governor.
    • The ADU has construction permits/passed necessary inspections.
  • Amends coastal development approval timeline under the California Coastal Act of 1976 to require local government of the California Coastal Commission to either approve or deny a coastal development permit application for an ADU within 60 days of receiving the application. If the Coastal Commission missed the deadline, the permit will be automatically deemed approved (subject to adhering to certain requirements).
  • The bill declares that California is facing a housing crisis due to the lack of housing availability and affordability.
  • States that solving the housing crisis will require a multifaceted approach that includes but is not limited to:
    • Encouraging an increase in the supply of housing.
    • Encourage development of affordable housing.
    • Remove the barriers to housing production.
    • Expand availability of rentals.
