State Land Use Enacted Legislation

Bill # State Year Party Topic

SB 358

CA 2025 D Impact fees, Lands near transit, Minimum parking requirements, Written findings, burden and standard of proof

Provided by Furman

Summary

  • If a local agency imposes a fee on a housing development with the purpose of reducing vehicular traffic impacts, the fee will be set at a rate reflecting the lower rate of automobile traffic as compared to certain prescribed characteristics. The bill stipulates that a local agency may only depart from the reduced-fee rate if it makes written findings supported by substantial evidence on the record that the development would not generate fewer trips even if the characteristics of subdivision (a) were present.
  • Overhauls proximity characteristics for housing developments, stating that the housing developments must be within a half mile of three or more of: “a supermarket or grocery store. (b) a public park. (c) a community center. (d) a pharmacy or drugstore. (e) a medical clinic or hospital. (f) a public library. (g) a school that maintains a kindergarten or any of grades 1 to 12, inclusive. (h) a licensed childcare facility. (i) a restaurant.”
  • Amends the characteristic related to parking spaces, requiring no more than one onsite parking space for 0-2 bedroom units and two onsite spaces for 3+ bedroom units.
