Summary

  • An act to amend Sections 65852.21 and 66411.7 of the Government Code, relating to land use.
  • Expands development opportunities by narrowing historic resources exclusion of the prior bill.
    • Development cannot be in a contributing structure within a historic district, allowing for development in a non-contributing structure within a historic district.
    • Excludes development on parcels individually listed on the State Historic Resources Inventory or designated as a city/county landmark (i.e. it is not enough for a parcel to be within a historic district, it must have an individual designation).
  • Allows local agencies to adopt objective standards for the purpose of maintaining historical value of historic districts.
  • Narrowed “historic district” to “historic landmark property”.
  • Adds a new requirement that proposed urban lot splits may not require demolition or alteration of either:
    • A contributing structure within a historic district included on the CA Register of Historical Resources.
    • An existing exterior structural wall of any structure on a historic district.
  • Establishes that no state reimbursement is required to local agencies for costs imposed by the act.
